• February 10, 2024-  No jury trials. Camp Lejeune victims and veterans will NOT be entitled to a trial by Jury, according to a panel of four federal judges. The panel of judges wrote a 34-page decision nixing plaintiffs’ attorneys arguments that a trial by jury was the  best way for sick and dying victims to get justice in front of a jury of their peers. The victim’s lawyers argument fell on death ears. The Four judge panel from the US District Court for the Eastern District of North Carolina reasoned, “Congress did not clearly and unequivocally depart from its usual practice of not permitting a jury trial against the United States” when Congress enacted the Camp Lejeune Justice Legislation to offer payouts to victims of the toxic water.  The ruling clarifies how trials will proceed in the now sprawling litigation with individual claims being determined by judges rather than juries. The US Justice Department attorneys argued that judge trials will expedite the complex litigation determining tens of thousands of lawsuits.
• January 1st, 2024- There have been more than 160,000 Camp Lejeune administrative claims filed. Over 1500 lawsuits have been filed. However, many more admin claims are expected before the August 2024 deadline. “The Agency for Toxic Substances and Disease Registry (ATSDR), based in Atlanta, Georgia, is a federal public health agency of the U.S. Department of Health and Human Services.”  https://www.atsdr.cdc.gov/ The ATSDR’s released a cancer incidence study determining that military personnel who were stationed at the military base had a greater than 20 percent likilihood for certain cancers than military personnel who were stationed at different areas of the country. The types of cancer determined to be at higher risk by the ATSDR: leukemia, lymphoma, lung cancer, breast cancer, throat cancer, esophagus cancer, and thyroid cancer. The ATSDR determined that non-military personnel (civilians) who were employed working at Camp Lejeune had a greater likilihood for cancers such as myeloid cancers, breast cancer as well as lung cancers.
• December 8th, 2023- Recent disclosure filed with the North Carolina Federal Court show that over 130,000 camp lejeune contaminated water lawsuit claims have been sent to the Navy Jag. Surprisingly, it has come to light that only approximately 1,400 Camp Lejeune water lawsuit have been actually filed in Federal Court in Eastern District Court of North Carolina. • September 7th, 2023 UPDATE: The U.S. Navy and the Justice Department rolled out a new settlement program named the “voluntary elective option” consisting of expedited tiered payouts  for certain victims of the contaminated water at the Marine base. Read the press release.  This new program will offer payments between $100,000 and $550,000 to veterans, civilian employees, deceased victims and others based on specific illnesses, harm as well as the length of time that a victim was exposed to the toxic water. Acceptance of the funds would be in lieu of going forward with an administrative claim or a Camp Lejeune water lawsuit. This settlement proposal was propounded unilaterally by the United States Navy and the Justice Department. It was not an agreement between leadership lawyers for the victims and the U.S. Justice Department and Navy! The settlement proposal is insufficient and we do not advise victims to accept this settlement. Scientific  studies determined that there was is a definitive link between the water at the marine base and non-Hodgkin’s lymphoma. NHL is one of the conditions/ diseases that is presumptively linked to Camp Lejeune contaminated water.

• Testicular Cancer- “Testicular cancer is a growth of cells that starts in the testicles… Testicular cancer isn’t a common type of cancer. It can happen at any age, but it happens most often between the ages of 15 and 45.”
• Pancreatic Cancer- “Pancreatic cancer begins in the tissues of your pancreas — an organ in your abdomen that lies behind the lower part of your stomach. Your pancreas releases enzymes that aid digestion and produces hormones that help manage your blood sugar. Several types of growths can occur in the pancreas, including cancerous and noncancerous tumors. The most common type of cancer that forms in the pancreas begins in the cells that line the ducts that carry digestive enzymes out of the pancreas (pancreatic ductal adenocarcinoma).”

Exposure to PCE-contaminated drinking water occurred because PCE leaked into groundwater that supplied the Tarawa Terrace drinking water system from a dry-cleaner located outside the Camp Lejeune military base.
